Passage of the sales tax will establish the Johnson County Education Research Triangle Authority

The Authority Board will consist of 7 members all of whom must be elected officials in Johnson County

The Authority members will be appointed by the Governor, Board of Regents, Johnson County Commission, Johnson County Community College, University of Kansas (2) and Kansas State University.

Authority members may serve two four year terms. Vacancies will be filled by the designated appointing group. Authority members who leave elected office will be replaced by the appointing group.

The Authority will conduct its meetings in accordance with the Kansas open meetings and open records law.

The Authority will elect a chairman within their group.

JCCC President, KSU President and KU Chancellor or their designees will serve as ad hoc advisors to the Authority.

The Authority will ensure that the tax revenues are divided and distributed in three equal parts to the KU Edwards BEST Center, the KSU National Food and Animal Health Institute and the KU Cancer and Clinical Research Center.

The Authority will ensure that the Triangle revenues are "new" money for construction, operations, maintenance and to conduct research and to offer degree programs. It is not to be used as substitute revenue for existing higher education programs currently funded by the state.

The Authority will ensure that all revenue collected is spent and remains in Johnson County.

The Authority will set criteria and administer the scholarship fund to be available to Johnson County residents as a stipend for Triangle programs and research.

The Authority will remit the revenues directly to the Universities who are governed by the Kansas Board of Regents.

The Authority will ensure that each facility have a budget that will include sufficient funds for ongoing maintenance of the facilities.

The Authority may use no more than 2% of the revenues for administration, legal services and auditing.

The Authority is subject to county, state and shall commission an annual independent audit.

The Authority will issue an annual progress report to the Johnson County Commission, the Governor, the Kansas Board of Regents, the Kansas Legislature and the citizens of Johnson County.
